DUSTRAÉ Terms of Service

1. About DUSTRAÉ

DUSTRAÉ is an online business management platform operated by Crystal Ann Jessica Feldman, an Australian sole trader (ABN 84 431 211 516), also trading as Dusty Blooms CQ.

By creating an account or accessing the platform, you agree to these Terms of Service.

2. Our Services

DUSTRAÉ provides digital tools to assist florists, event stylists and other event professionals with their business operations.

Features may include:

• Client management and quoting.
• Event plans and operational documents.
• Floral recipes and consolidated ordering.
• Hire inventory management.
• Saved quote items and templates.
• AI-assisted descriptions and colour palettes.
• Optional Google Calendar availability checking.
• Feedback and support messaging.

Available features may vary depending on account access, subscription arrangements and ongoing platform development.

3. Accounts and Access

Users must provide accurate registration information and keep their login credentials secure.

Each business account currently operates through an individual login. Shared staff accounts and multi-user team permissions are not presently supported.

Users are responsible for activities undertaken through their accounts, subject to applicable law.

Unauthorised access or suspected account compromise should be reported promptly.

4. Business Content and Client Information

Users retain their rights to original business content, client information, photographs and other materials submitted to DUSTRAÉ.

By uploading content, users authorise DUSTRAÉ and its relevant service providers to store, process and use that content as reasonably necessary to deliver the platform's functions.

Users are responsible for ensuring they have appropriate rights or permissions to upload and process materials, including third-party photographs and client information.

Users must comply with applicable privacy, intellectual property and consumer protection obligations.

5. Quotes, Estimates and Business Documents

DUSTRAÉ provides administrative and calculation tools.

Users are responsible for checking the accuracy of:

• Product and service prices.
• Labour, delivery and travel charges.
• GST settings and calculations.
• Floral recipes and ordering quantities.
• Inventory availability.
• Event instructions and contact details.
• Generated PDFs and other documents.

DUSTRAÉ does not independently verify the accuracy of information entered by users.

The platform does not replace professional, accounting, financial or legal advice.

6. AI-Assisted Features

Some features use external AI services to generate descriptions, colour palettes or other content.

AI outputs may be inaccurate, incomplete or unsuitable.

Users are responsible for reviewing generated content before relying on it or providing it to customers.

Use of AI features may involve sending uploaded images and relevant client or event details to external service providers, as described in our Privacy Policy.

7. Google Calendar Integration

Google Calendar integration is optional and requires user authorisation.

DUSTRAÉ may use calendar information to identify possible scheduling conflicts.

A date shown as available or unavailable is not a guaranteed confirmation of booking capacity.

Users remain responsible for independently managing their schedules and confirming bookings.

Disconnecting Google Calendar revokes the application's connected access, although certain saved calendar preferences and manually blocked dates may remain.

8. Founding Pilot

DUSTRAÉ may provide selected businesses with complimentary access through a limited Founding Pilot.

The current Founding Pilot is designed as a 56-day testing period, subject to the access details communicated to each participant.

Pilot functionality may contain bugs, incomplete features or other issues associated with software development.

Participants are encouraged to report issues and provide feedback.

Complimentary pilot participation does not automatically create a paid subscription or guarantee ongoing free access after the pilot period.

Any future paid access will be subject to separately disclosed pricing and applicable terms.

9. Subscriptions and Payments

DUSTRAÉ may offer paid subscription plans or additional products in the future.

Before a paid subscription is activated, applicable pricing, billing frequency, renewal conditions and cancellation arrangements will be communicated to the customer.

No payment obligation arises solely from joining a complimentary Founding Pilot.

Additional commercial terms may be introduced when paid services become available, subject to applicable law.

10. Acceptable Use

Users must not:

• Use the platform for unlawful or fraudulent activities.
• Attempt to access another business's information without authorisation.
• Upload malicious software.
• Interfere with platform security or operation.
• Infringe intellectual property or privacy rights.
• Misuse third-party integrations.

DUSTRAÉ may restrict or suspend access where reasonably necessary to address material breaches, security threats or unlawful activity.

11. Platform Availability and Development

DUSTRAÉ is an evolving software platform.

Features may be updated, modified or temporarily unavailable due to maintenance, technical issues or third-party service interruptions.

We aim to provide a functional and reliable service but cannot guarantee uninterrupted or error-free operation.

Where applicable, changes affecting paid services remain subject to Australian Consumer Law and other legal obligations.

12. Data Access and Account Closure

Users may contact DUSTRAÉ to request account closure, access to their information or deletion of personal information.

Account deletion can be requested through Business Profile and is processed as described in the Privacy Policy. Complete account-data export is not currently available.

Requests will be assessed in accordance with applicable law and technical capabilities.

Certain information may need to be retained or may not be immediately removable through existing platform functions.

13. Intellectual Property

The DUSTRAÉ software, interface, branding and original platform materials are protected by applicable intellectual property laws.

Users do not acquire ownership of the platform by creating an account or using its services.

Users retain applicable rights in their own original content.

14. Liability and Consumer Guarantees

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under Australian law.

To the extent permitted by law, DUSTRAÉ is not responsible for errors arising from inaccurate information supplied by users, unreviewed AI-generated outputs or business decisions made without independently checking platform-generated documents.

Any applicable limitation of liability remains subject to mandatory legal protections.

15. Changes to These Terms

We may update these Terms as the platform evolves.

Where required by law or reasonably appropriate, material changes affecting existing users will be communicated.

The current version will be available through the DUSTRAÉ website.

16. Governing Law

These Terms are governed by the laws of Queensland, Australia, subject to any mandatory applicable laws.
